Overview of position
Somalia Joint Justice Programme (JJP), launched in August 2018, is a 30-month programme supporting the Somalia National Development Plan (NDP) 2017-2019 goal to “Establish independent, accountable and efficient justice institutions capable of addressing the justice needs of the people of Somalia.” The first outcome of the programme focuses on supporting the delivery of justice services that respond to the needs of the people particularly the most vulnerable through a multipronged approach including community conversations to involve communities in the development and implementation of justice responses, social transformation, support to alternative/community dispute resolution centers (ADR/CDR) legal aid and legal awareness and mobile courts. The programme has already established some alternative disputes resolution centres and is currently developing a new concept of community disputes resolution centres including two components: an alternative dispute house and a women empowerment centre.

The traditional justice system tends to perpetuate discriminatory practices and harmful social norms, particularly towards women or members of minority clans. For example, clan dynamics is an important contributing factor to land conflict with major powerful clans evicting or dispossessing the most vulnerable ones from their lands. Women have also been deprived of access to land including through deprivation of their inheritance rights. As those practices and social norms are deeply embedded in tradition and culture, change will only happen through deep social transformation within the communities and focus should be placed on transformational change within communities in order to address them. More generally, issues related to justice are framed by the social dynamics/relationships.

To assist such transformation and ensure that CDRC provide fair justice services, the JJP started implementing a pilot project on traditional justice mechanisms and Nonviolent Communication NVC). NVC “is based on the principles of nonviolence — the natural state of compassion. NVC begins by assuming that we are all compassionate by nature and that violent strategies—whether verbal or physical—are learned behaviours taught and supported by the prevailing culture. NVC also assumes that we all share the same, basic human needs, and that all actions are a strategy to meet one or more of these needs. The aim of NVC is to increase understanding within communities, deepening connection and conflict resolution’. NVC was developed by the American psychologist, Dr. Marshall Rosenberg, and has proven to be a powerful tool to empower human beings to transform systems that perpetuate injustice and violence. NVC aims to cultivate greater critical awareness of how certain institutional/social structures and power dynamics serve to divide and dehumanize people and communities. It helps support the transformation and strengthen the connection among members of the community to correct power imbalance.

As part of this project, the JJP provided a series of trainings to a target group of 60 women leaders, religious leaders, and traditional elders in Baidoa and Kismayo as part of the ADRC/CDRC. The overall objective of the training was to encourage the transformation of the traditional justice system towards more social justice, particularly towards women and vulnerable groups, by encouraging dialogue through Non-Violent Communication.
The more specific objectives include:

  • Train 20 traditional elders, 10 religious leaders and 30 women leaders in each location (Kismayo and Baidoa) on Non-Violent Communication skills, including the four basic steps to Non-Violent Communication’ as well as the concept of needs, feelings, strategies and requests; empathy, self-empathy, dealing with anger and restorative justice principles and tools (mediation, restorative circle);
  • Help participants develop new frames of thinking to identify divisive behaviours and harmful social practices and understand their causes;
  • Give the participants the necessary tools, particularly women, to bring social transformation and social justice starting from the individual (internal) to the interpersonal (among human beings)/communities and then institutional/systemic levels;
  • Support the participants in identifying clear strategies for social transformation.

The Joint Justice Programme will build on the results of the pilot project on Non-Violent Communication and will aim to expand the training to remaining traditional elders, religious leaders and women leaders in the community, deepening the knowledge and skills of the beneficiaries, supporting the emergence of community based responses to SGBV that fosters healing, establish restorative justice system that fosters win-win solutions empowerment and self-responsibility. It also aims at ensuring sustainability for larger-scale change to emerge.
Within this context, our client under the auspices of the JJP requires services of an individual contractor to develop and conduct a training/mentorship programme on NVC for traditional elders, religious leaders and women leaders in support of NVC in Somalia.

Role objectives
  • To develop and conduct a training/mentorship programme on NVC for traditional elders, religious leaders and women leaders in support of NVC in Somalia.
  • To strengthen the capacities of the women section of the CDRS through training on counselling and women leadership
  • To establish a pool of experts to support the centres and justice practices
Scope of work:
Building upon the first phase of the initiative, the consultant will provide basic training on Non-violent Communication to religious leaders, traditional elders and women leaders who did not benefit from the first training phase. The person will support the community disputes resolution centres, including the women empowerment section. The support will address power relations and focus on reconciliation, win/win solutions (restorative dialogue) and victim/survivor cantered approach.
The consultant shall:

  • Provide training on NVC for members of the Community disputes resolution centers (traditional elders, religious elders and women leaders;
  • Total number of training shall include 60 people and provided through two sets of trainings. The first set of trainings shall include 30 women leaders. The second set shall include 15 religious leaders and 15 traditional elders. The third set shall include four joint training for the first and second sets of groups. Total number of days per location shall be 32 for Baidoa and Kismayo

respectively. The training shall include support for the establishment of justice practices that foster self-responsibility, reconciliation, win-win solution such as restoration circles and empathic circles through coaching and mentoring

  • The consultant shall observe and comment the changes that were observed in the two locations of the I implementation is Kismayo and Baidoa
  • Strengthen the capacities of the women section of the CDRS through training on counselling and women leadership;
  • Total number of training shall include one nine-day training for 40 women in Kismayo and Baidoa
  • At the end of these trainings, a series of human-interest stories shall be identified by consultant and provided to our client for lessons and learning and for preparing media outreach stories.
  • Establish a pool of national experts to support the centres and justice practices;
  • Develop Terms of Reference for the Centre for Justice Practices
  • Develop curricula o NVC for trainer of trainers (ToT)
  • Develop criteria for identification of experts for ToT course.
  • Develop and support the implementation of a curricula on NVC.

The training and mentoring methodology will be a combination of theoretical knowledge on NVC, discussion and role plays using practical examples from Somalia. Some of the mentoring sessions will be done in-site with real cases scenario and with the parties to the conflict or the beneficiaries of the counselling.

Key competencies Academic Qualifications
· Certification as a trainer by the Centre for Non-violent Communication (CNVC)
Experience:
· At least 10 years’ experience as a trainer on Non-violent communication;
· Experience in developing and conducting leadership and adult training;
· Experience in counselling, reconciliation work, restorative justice, particularly in fragile, conflict and
post conflict contexts.
