Overview of Position

Organizational context:

  • Our client is an operational arm of the United Nations, supporting the successful implementation of its partners’ peacebuilding, humanitarian & development projects around the world. Mandated as a central resource of the United Nations, our client provides sustainable project management, procurement & infrastructure services to a wide range of governments, donors & United Nations organizations. With over 6,000 personnel spread across 80 countries, our client offers its partners the logistical, technical & management knowledge they need, where they need it. By implementing around 1,000 projects for their partners at any given time, our client makes significant contributions to results on the ground, often in the most challenging environments.

Background Information: Somalia Country Office (SOCO):

  • Our client has been operating in Somalia since 1995. The Somalia Country Office (SOCO) forms part of the Kenya Multi Country Office (KEMC) & manages & coordinates a diverse portfolio across a variety of sectors, including health, rule of law, crisis recovery & security & justice reform. Located in Mogadishu, SOCO works with multiple partners including the governments of Somalia, bilateral & multilateral donors, United Nations agencies, funds & programs.

Specific context:

  • Our client will provide technical assistance to the Federal Government of Somalia (FGS) for the transparent, efficient & sustainable planning & execution of a competitive tender process for contracting a passport services supplier in accordance with international best practices, standards & security regulations as defined by the International Civil Aviation Organization (ICAO). The Legal Expert will work alongside the PPP Expert during the tender phase to ensure that the tender documentation is fully compliant with the Somali Procurement Act.

Role Objectives

Under the direct supervision of the Head of Program & in close communication with the technical teams of the Immigration & Naturalisation Directorate (IND) of the Ministry of Internal Security, the procurement department of the Ministry of Finance, the Public Private Partnerships (PPP) Expert will work alongside the Legal Advisor to draft all the necessary tender documentation in accordance with the Somali Procurement Act. Overall responsibilities include but are not limited to:

  • Collaborate with the Legal Advisor to draft all necessary tender documents, including Request for Proposals (RFP), evaluation criteria & methodology, contract templates.
  • Ensure all tender documents are clear, concise & compliant with the Somali Procurement Act & relevant PPP regulations.
  • Participate in stakeholder consultations & meetings to explain the PPP process & answer questions.

Specific responsibilities include but are not limited to:

Project feasibility & structuring:

  • Analyze the technical & financial feasibility of the PPP approach for passport production.
  • Develop different PPP models (concession, BOT) with risk allocation & payment mechanisms.
  • Evaluate potential international suppliers & assess their technical & financial capabilities.

Tender preparation & management:

  • Assist in drafting the RFP documents, ensuring adherence to PPP best practices & local procurement regulations.
  • Support with pre qualification of bidders & manage the tender process, including clarifications & responses to inquiries.
  • Evaluate technical & financial proposals alongside the Legal Expert, applying fair & transparent criteria.

Contract negotiation & finalization:

  • Work with the Legal Expert to negotiate the PPP contract with the selected bidder, ensuring alignment with project objectives & risk mitigation strategies.
  • Address complex legal & commercial issues related to technology transfer, data security, performance guarantees & dispute resolution.

Financial structuring & modelling:

  • Participate in developing the financial model for the project, considering upfront investments, operational costs, revenue streams & affordability for the government.
  • Analyze financial risks & recommend mitigation strategies.

Project implementation & monitoring:

  • Support the government during the project implementation phase, ensuring compliance with contractual obligations & agreed upon performance standards.
  • Monitor project progress & identify potential issues or deviations, proposing corrective actions as needed.
  • Participate in regular meetings with stakeholders & provide progress reports.

Project Reporting

Key Competencies

  • Master’s degree in law, business administration, economics, finance, public administration, or a related field, with a specialization in PPPs or infrastructure development is required or a bachelor’s degree in the same field or a related field is often essential with a combination of two years of relevant experience may be accepted in lieu of the masters degree.
  • Minimum of 2 years of experience working on PPP projects, either in the public sector, private sector, or with international organizations, is crucial, this includes involvement in structuring, financing, managing, or advising on PPP projects.
  • Proficiency in financial modeling, risk analysis & project finance is important, as PPPs often involve complex financial structures.
  • Familiarity with legal & regulatory frameworks governing PPPs in various jurisdictions is vital for drafting & negotiating contracts & ensuring compliance.
  • Strong communication & negotiation skills are essential for dealing with multiple stakeholders, including government entities, private companies & financial institutions.
  • Ability to manage projects, including planning, execution & monitoring, is important for the successful delivery of PPP projects.
  • Strong analytical & problem solving skills are necessary for assessing projects, identifying risks & proposing solutions.
  • Professional working proficiency in spoken & written English is required & proficiency in Somali language is a plus.
  • Demonstrates understanding of the impact of own role on all partners & always puts the end beneficiary first. Builds & maintains strong external relationships & is a competent partner for others (if relevant to the role).
